Terms of Service

1. About Octopus Productivity Solutions

Octopus Productivity Solutions (“OPS,” “we,” or “us”) provides virtual assistance, automation, project support, and related business-productivity services. By purchasing or using any OPS service, you agree to these Terms of Service.


2. Payments and Packages

  • Fees are determined based on the client’s Billing Location and applicable pricing, regardless of which pricing page, link, or URL is used to complete a purchase.

  • “Billing Location” means the country where you and/or your organization’s primary place of business is located and where you are invoiced for services.

  • Clients with a Billing Location in Canada are priced in Canadian Dollars (CAD). Clients with a Billing Location other than Canada are priced in US dollars (USD), unless otherwise agreed in writing.

  • Payments are processed through third-party payment processors. While pricing is set in CAD or USD as described above, payment processors may allow clients to complete payment in their local currency and may apply currency conversion at the time of payment.
  • If a purchase is completed using pricing that does not correspond to the client’s Billing Location, Octopus Productivity Solutions reserves the right to cancel the transaction, issue a refund, and reissue a payment request at the correct price.
  • You confirm that the information you provide at checkout, including your billing address, accurately reflects your Billing Location.

  • All OPS Hours are paid in advance through Stripe or another approved method, unless agreed in writing.
  • Any such currency conversion does not change the underlying pricing, which remains based on the applicable CAD or USD price.
  • Packages are sold as blocks of time (for example, 5 hours, 10 hours, 15 hours).

     

  • No refunds are offered once payment is complete.
  • Purchased hours expire six months from the purchase date. Unused hours are forfeited after that period, unless extension is agreed on in writing 30 days prior to expiry.

3. Booking, Rescheduling, and Cancellations

  • You may reschedule meetings or task start dates with at least 24 hours’ notice.

  • Sessions canceled or rescheduled with less than 24 hours’ notice may be charged in full or deducted from your remaining hours.

  • OPS reserves the right to reschedule sessions due to illness, emergency, or unavoidable conflict.


4. Billing Discrepancies and Corrections

If we determine, in our reasonable discretion, that a payment was processed using pricing not applicable to your Billing Location, we may:

(a) Cancel the transaction;
(b) Issue a refund for the incorrect transaction; and
(c) Reissue a new payment request at the correct price in the correct currency.

We will notify you in writing of any such correction. Continued use of Services after notice will constitute your acceptance of the corrected pricing.


5. Service Conduct and Client Responsibilities

Clients agree to:

  • Provide timely information and feedback needed to complete work.

  • Communicate respectfully and professionally.

  • Refrain from requesting unlawful, unethical, or misleading tasks.
    OPS may decline or discontinue any engagement that violates these principles.


6. Ownership and Intellectual Property

  • Deliverables you purchase and pay for (documents, automations, templates, etc.) belong to you once payment is received in full.

  • OPS retains ownership of all background materials, processes, templates, and know-how used to produce those deliverables.

  • OPS may reuse generic frameworks, tools, or concepts developed during client work.


7. Limitation of Liability

OPS provides services on a best-effort basis.

  • We are not liable for indirect, incidental, or consequential losses, including loss of revenue or data.

  • Our total liability for any claim is limited to the amount you paid for the relevant OPS Hours.


8. Termination

Either party may end a working relationship with written notice.

  • Unused prepaid hours remain non-refundable.

  • Any outstanding work in progress will stop once notice is given.


9. Updates to These Terms

OPS may update these Terms from time to time. The most current version will always be available at octopusproductivity.ca/terms, and the “last updated” date will change accordingly.
